    The Hidden Risks of FSBO

    Selling your home "For Sale By Owner" (FSBO) might seem like a great way to save on commission, but without disciplined diligence, you expose yourself to significant legal and financial risks. Here are the top 5 contract pitfalls we see FSBO sellers make.

    1. Mishandling the Option Period

    In Texas, the option period gives the buyer the unrestricted right to terminate the contract for a specified number of days. If you don't collect the option fee within the strict 3-day timeframe, or if you miscalculate the days, you could be locked into a contract with a buyer who can walk away at any time.

    2. Incomplete Seller's Disclosure

    Failing to properly disclose known defects is the number one cause of post-sale lawsuits. The Texas Seller's Disclosure Notice is extensive, and missing a single checkbox can lead to devastating legal consequences months after closing.

    3. Misunderstanding Financing Contingencies

    Just because a buyer has a pre-approval letter doesn't mean they will get the loan. If you don't properly structure the Third Party Financing Addendum, you could have your home off the market for 30 days, only for the buyer to back out at the last minute and keep their earnest money.

    4. Appraisal Shortfalls

    What happens if the home doesn't appraise for the contracted price? Without a skilled negotiator, you might be forced to drop your price or lose the deal entirely. We use specific addendums to protect your bottom line in the event of a low appraisal.

    5. Title and Survey Issues

    Who pays for the title policy? Do you have an existing survey, and if so, is it accompanied by the required T-47 affidavit? Missing the deadline to deliver these documents gives the buyer an easy out.
